DC Govinda Reddy, a 65-year-old MLC (member of legislative council) of Kadapa in Andhra Pradesh, has complained that HS Shantha Kumar, a resident of Langford Town in Bangalore, has defrauded him worth crores. Instead of registering and selling land through his firm, Reddy alleges that Kumar fraudulently misused the general power of attorney and registered land in his name and sold it off without his knowledge.
In 2006, Kumar approached Reddy as a land developer and claimed to know several landlords. Kumar asked him to invest in land to gain more returns. In addition, he said he would develop Reddy’s land for greater profits. Towards this end, Reddy visits survey number 14/A in Kasavanahalli in 2006 for a land measuring 6 acres and 20 juntas. Kumar introduced Reddy to one Krishnappa and his family who claimed to be owners of this land parcel. Reddy decides to develop this land with Kumar and prepares a deed of declaration on August 30, 2006 and September 2, 2006.
On September 2, 2006, Reddy signs a MOU (Memorandum of Understanding) to start a business called GS Developers and decides to buy Krishnappa’s Kasavanahalli land. Towards this end, Reddy apparently pays Rs 1.89 crore to various site holders in the land parcel.
After this step, as per the MOU, Rs 1.12 crore is also paid in advance to various vendors. Reddy then apparently assigns Kumar to get the land registered the company’s name. However, Kumar gets the land registered in his name by misusing the GPA (general power of attorney) instead of GS Developers.
Later, Kumar allegedly sells these lands to others and cheats Reddy of his money and land. This went on till December 13, 2019 before Reddy approached the Bellandur police station to file an official complaint. The cops have registered a case of criminal breach of trust and cheating, and are investigating.
